This Privacy Policy describes how We collect, use and disclose Your information when You use the Webshop and tells You about Your privacy rights and how the law protects You.

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Account

A unique account created for You to access our Webshop or parts of our Webshop.

Affiliate

An entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

Application

The software program provided by the Company downloaded by You on any electronic device, named Veloretti

Company

Veloretti BV, Moermanskkade 401, 1013 BC, Amsterdam, also referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy. 

For the purpose of the GDPR, the Company is the Data Controller

Data Controller

The legal person who alone or jointly with others determines the purposes and means of the processing of Personal Data. The Company is a Data Controller.

Data Processor

Any natural or legal person who processes the Personal Data on behalf of the Company.

Device

Any device that can access the Webshop such as a computer, a cell phone or a digital tablet.

A public profile named Veloretti specifically created by the Company on the Facebook social network, accessible from https://www.facebook.com/Veloretti/.

GDPR

The General Data Protection Regulation, also referred to as the applicable privacy legislation.

Any information that relates to an identified or identifiable individual, also referred to as personal information.

For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.

Service Provider

any natural or legal person who processes the data on behalf of the Company. It refers to tThird-party companies or individuals employed by the Company to facilitate the Webshop, to provide the Webshop on behalf of the Company, to perform services related to the Webshop or to assist the Company in analyzing how the Webshop is used. 

For the purpose of the GDPR,If individual Service Providers are considered Data Processors, the Company will conclude a data processing agreement with the relevant Service Providers.

Legitimate interest: We send offers about similar products or services that You have previously ordered with Us on the basis of Our legitimate interest. You always have the option to unsubscribe from Our mailings, e.g. via the unsubscribe link in Our marketing e-mails.

We process Your Personal Data for the purposes of (i) providing information with regard to products or services that You might like, and (ii) providing offers.

For business transfers, to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Webshop users is among the assets transferred.

We collect these Personal Data on the basis of Our legitimate interests, namely providing Our Webshop to You as a registered user.

We process Your Personal Data for purposes of (i) exploring the options to carry out a reorganization or a restructure or the like.

For other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Webshop, products, services, marketing and your experience.

We may process Your Personal Data for purposes of (i) following requests of public authorities, (ii) conducting criminal investigations, prosecutions, trails and the execution of judgments, (iii) protecting rights of third parties, (iv) conducting statistical or academic researches, or (v) other circumstances as stipulated by relevant laws and regulations.

4. Sharing with Third Parties

We may share Your personal information in the following situations:

  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Webshop, to show advertisements to You to help support and maintain Our Webshop, to advertise on third party websites to You after You visited our Webshop, for payment processing, to contact You. For instance payment providers such as Mollie and PayPal and marketing companies or services such as Google, Facebook and Klaviyo. Other categories of Service Providers we engage are hosting providers, cloud providers and IT service providers.

  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.

  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.

  • With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions.

  • With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside. If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.

  • With Your consent: We may disclose Your personal information for any other purpose with Your consent.

We do not involve parties that are located outside the European Economic Area (“EEA”) for the processing of Your Personal Data. If this will be the case in the future, We will duly inform You of that matter and the procedure as explained below will apply.

Transfers of Your Personal Data to a country outside the EEA may in the first place be legitimized on the basis of a so-called adequacy decision. This is a decision in which the European Commission states that e.g. a certain country offers a level of data protection similar to the GDPR. See this link for the current list of adequacy decisions. If and insofar as We transfer Personal Data with parties in countries outside the EEA to which no adequacy decision applies, We will agree with these parties to data protection provisions set by the European Commission, so called standard contractual clauses. A copy of the agreed standard contractual clauses can be requested by You.

5. Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data by law or in response to valid requests by public authorities (e.g. a court or a government agency).

8. Your Rights under the GDPR

The Company undertakes to respect the confidentiality of Your Personal Data and to guarantee You can exercise Your rights.

You have the right under this Privacy Policy, and by law if You are within the EU, to:

  • Request access to Your Personal Data. The right to access, update or delete the information We have on You. Whenever made possible, you can access, update or request deletion of Your Personal Data directly within Your account settings section. If You are unable to perform these actions yourself, please contact Us to assist You. This also enables You to receive a copy of the Personal Data We hold about You.

  • Request correction of the Personal Data that We hold about You. You have the right to have any incomplete or inaccurate information We hold about You corrected.

  • Object to processing of Your Personal Data. This right exists where We are relying on a legitimate interest as the legal basis for Our processing and there is something about Your particular situation, which makes You want to object to Our processing of Your Personal Data on this ground. You also have the right to object where We are processing Your Personal Data for direct marketing purposes.

  • Request erasure of Your Personal Data. You have the right to ask Us to delete or remove Personal Data when there is no good reason for Us to continue processing it.

  • Request the transfer of Your Personal Data. We will provide to You, or to a third-party You have chosen, Your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which You initially provided consent for Us to use or where We used the information to perform a contract with You.

  • Withdraw Your consent. You have the right to withdraw Your consent on using your Personal Data. If You withdraw Your consent, We may not be able to provide You with access to certain specific functionalities of the Webshop.

  • Automated decision-making. You have the right not to be subject to a decision based solely on automated processing, which significantly impacts You (“which produces legal effects concerning You or similarly significantly affects You”). In this respect, please be informed that when processing Your personal data, We do not make use of automated decision-making.

9. Exercising of Your GDPR Data Protection Rights

You may exercise Your rights of access, rectification, cancellation and opposition by contacting Us. Please note that We may ask You to verify Your identity before responding to such requests. We will provide You with information about the follow-up to the request without undue delay and in principle within one month of receipt of the request. Depending on the complexity of the request and on the number of requests, this period can be extended by another two months.

You have the right to complain to a Data Protection Authority about Our collection and use of Your Personal Data. Our lead Data Protection Authority is the Dutch Autoriteit Persoonsgegevens. 

10. Data Controller for the Facebook Fan Page

The Company is the Data Controller of Your Personal Data collected while using the Webshop. As operator of the Facebook Fan Page https://www.facebook.com/Veloretti/, the Company and the operator of the social network Facebook are Joint Controllers.

The Company has entered into agreements with Facebook that define the terms for use of the Facebook Fan Page, among other things. These terms are mostly based on the Facebook Terms of Service: https://www.facebook.com/terms.php

11. Children's Privacy

Our Webshop does not address anyone under the age of 16. We do not knowingly collect personally identifiable information from anyone under the age of 16. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 16 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

12. Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.

We will let You know via email and/or a prominent notice on Our Webshop, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.
